Privacy Policy

This Privacy Policy explains how personal data is collected and used when you visit wearehumanmarketing.com (the “Site”) or contact Human Marketing Agency. It is provided under Regulation (EU) 2016/679 (GDPR) and the applicable Italian data protection law.

1. Data controller

2. Data we collect

  • Information you send us. When you use the “Book a call” form we collect your first and last name, email address, company, website, your monthly ad budget range, platforms of interest and the goals you describe. We save these details step by step as you move through the form (starting when you continue from the first step), even if you then do not finish the form or do not complete a booking. To link the later steps to the same request, your browser keeps a random code for the duration of your visit. To save you from typing them twice, we pass your name and email to the embedded Calendly calendar, which is provided by Calendly; the details you enter there when you book are processed by Calendly.
  • The chat assistant. The Site has an AI assistant. The messages you write in the chat are sent to a chat service we run on Cloudflare, which uses Google's Gemini model to produce the answers. We do not store the conversation on our own servers. If you ask to be contacted and send the contact form in the chat, we receive your name, phone number or WhatsApp, email (if you give it), your message and a short summary of the conversation, and we save them as a contact request. To protect the chat from automated abuse we use Cloudflare Turnstile, which runs only when you start a conversation. Please do not share sensitive data in the chat.
  • How you reached the Site. When you submit the booking form we also save the campaign parameters (UTM) and advertising click identifiers (such as gclid or fbclid) contained in the link you clicked, and the website that referred you, if any. We do not store these on your device: we read them from the address of the page when you continue in the form, and keep them together with your request to understand which campaigns bring us enquiries.
  • Browsing data. Like most websites, our servers record technical data such as IP address, browser type, pages requested and date and time of the request.
  • Cookies and similar technologies. With your consent, we use analytics and advertising tools (Google Tag Manager, Google Analytics, Google Ads and the Meta Pixel) to measure how the Site is used and how our advertising performs, including the pages you visit, your clicks on our “Book a call” buttons and your progress through the booking form. No personal details such as your name or email are sent to these tools. See section 7.
  • Cookieless measurement before you choose. Our Google tags (Google Consent Mode) are active when you arrive, with all cookies and advertising signals switched off until you decide. In this state they may send Google anonymous, cookieless measurement signals that include technical information such as your IP address, browser type, the page address and the state of your cookie choice. Click identifiers are removed from these signals. The Meta Pixel is not loaded until you accept marketing cookies.

3. Why we use your data and on what legal basis

  • To reply to your requests and prepare a possible collaboration (steps taken at your request before entering into a contract, Art. 6(1)(b) GDPR).
  • To answer your questions in the chat and to pass on your request when you ask to be contacted (steps taken at your request before entering into a contract, Art. 6(1)(b) GDPR; for the automated protection of the chat, our legitimate interest, Art. 6(1)(f) GDPR).
  • To understand which campaigns and channels bring enquiries, by saving how you reached the Site together with your request (our legitimate interest in measuring the effectiveness of our marketing, Art. 6(1)(f) GDPR). You can object at any time using the contact details above.
  • To run and secure the Site and prevent abuse (legitimate interest, Art. 6(1)(f) GDPR).
  • To measure the Site and our advertising through analytics and advertising cookies (your consent, Art. 6(1)(a) GDPR). You can withdraw consent at any time.
  • To measure overall Site traffic with cookieless signals before you make a choice, and when you refuse cookies (our legitimate interest in understanding how the Site is used, Art. 6(1)(f) GDPR). No cookies are stored on your device for this, and you can object at any time using the contact details above.
  • To comply with legal obligations, such as accounting and tax rules, when a contract is concluded (Art. 6(1)(c) GDPR).

Providing the data marked as required in the form is necessary to reply to you; without it we cannot process your request.

4. Who receives your data

We do not sell your personal data. Data may be processed on our behalf by providers that help us run the Site and our business, acting as data processors or independent controllers, such as our hosting and infrastructure provider, Calendly (scheduling), Google (analytics and advertising tools, and the Gemini model that powers the chat assistant), Cloudflare (the chat service and its anti-abuse check), Telegram (where requests from the chat are delivered to us) and Meta (advertising tools). They may only use the data for the purposes described in this policy and in their own privacy notices. Data may also be disclosed to authorities where the law requires it.

5. Transfers outside the European Economic Area

Some of the providers above are based in, or may process data in, countries outside the EEA, including the United States. Where this happens, transfers rely on an adequacy decision (such as the EU-US Data Privacy Framework) or on Standard Contractual Clauses approved by the European Commission.

6. How long we keep your data

Chat conversations are not stored by us; requests sent through the chat form are kept like any other contact request (see below). The providers of the chat service handle the messages under their own policies. Contact requests are kept for as long as needed to answer you and, if no collaboration follows, for up to 24 months. If a contract is concluded, we keep the data needed for the duration of the contract and then for the periods required by accounting and tax law. Analytics and advertising data are kept according to the retention settings of the tools used and the lifetime of the cookies.

7. Cookies

Cookies are small files stored on your device. Technical cookies needed for the Site to work do not require consent. When you first visit, a banner lets you accept, reject or customize analytics and marketing cookies; they are used only if you accept them. Your choice is remembered for up to 6 months and you can change or withdraw it at any time with the “Cookie settings” link in the footer. When you withdraw a category, we delete the cookies of that category that we can reach. Your language choice for the Site is remembered in your browser. The booking calendar on the “Book a call” page is provided by Calendly, which may set its own cookies. The full list of cookies and tools is in our Cookie Policy.

8. Your rights

Under the GDPR you have the right to access your data, to have it corrected or erased, to restrict or object to its processing, to receive it in a portable format and to withdraw your consent at any time, without affecting the processing carried out before withdrawal. To exercise these rights, write to arturo@wearehumanmarketing.com. You also have the right to lodge a complaint with the Italian data protection authority (Garante per la protezione dei dati personali, www.garanteprivacy.it) or with the authority of your country of residence.

9. Children

The Site is aimed at businesses and is not intended for people under 16. We do not knowingly collect their data.

10. Changes to this policy

We may update this policy from time to time. The date at the top shows when it was last changed.
